Terms and Conditions

Interpretation

In these Terms and Conditions:

“Euro Heating” refers to Euro Heating Pty Ltd.

“Purchaser” refers to any person, company, or organisation supplied with goods or services by Euro Heating.

“Goods” refers to any products, accessories, or services supplied by Euro Heating to the Purchaser.

Price

Unless otherwise agreed in writing:

Prices are as per the current Euro Heating price list, less any approved trade discounts or special pricing agreements.

Prices include any applicable government tax, excise, or levy relating to the sale, delivery, or manufacture of goods.

Retention of Title

Ownership of goods remains with Euro Heating until full payment of all monies owing under this or any related contract.
a. Until full payment is received, Purchasers must store goods in a way that clearly identifies them as the property of Euro Heating.
b. If goods are resold to a customer before payment is made, the Purchaser must hold all proceeds from that sale in trust for Euro Heating.
c. In the event of default or insolvency, Euro Heating reserves the right to enter the Purchaser’s premises (or any other location where goods are held) to recover goods.

Delivery

Goods are at the Purchaser’s risk immediately upon delivery to the agreed address.

Claims for short delivery or incorrect goods must be made in writing within 3 business days of delivery.

Euro Heating is not liable for any loss or consequential damages caused by late or failed delivery.

Return of Goods (Undamaged)

Euro Heating may, at its sole discretion, accept the return of undamaged goods. If accepted:
a. A completed Credit Request Form must be submitted and approved.
b. Return freight costs will be deducted from any applicable credit or refund.
c. Goods must be returned in their original condition.

Note 1: Special-build (non-standard) items are not eligible for return or credit.
Note 2: Returns may be subject to a restocking fee. Goods returned after 60 days may be refused.

Return of Goods (Damaged or Faulty)

a. Goods damaged in transit by Euro Heating or transport arranged by Euro Heating are covered by insurance. Damage during customer-arranged transport is at the customer’s risk.
b. Damaged goods must be reported within 3 business days of delivery.
c. Faulty goods will be replaced and charged to the Purchaser’s account. Upon inspection and confirmation of liability by Euro Heating or the manufacturer, the replacement charge will be fully credited.

Note 1: Faulty goods are covered under Euro Heating’s standard warranty conditions (available on request).
Note 2: Faults caused by incorrect or poor installation are not covered by warranty.

Waiver

Any failure or delay by Euro Heating to enforce these Terms and Conditions does not constitute a waiver of its rights.

Governing Law

These Terms and Conditions are subject to applicable legislation and trade practices in the State or Territory where the sale takes place.

Acceptance of Terms

By accepting delivery of goods, the Purchaser acknowledges and agrees to these Terms and Conditions of Sale.
